Terms of Service

These Terms of Service (“Terms”) explain the rules for using Freedom Wall. They form a binding agreement between you and the operator of Freedom Wall (“we,” “us,” or “our”).

By accessing or using the platform - including browsing, signing in, posting, or accepting these Terms - you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the service.

1. Eligibility and acceptance

You must be at least 13 years old and able to enter a binding contract. If you use the platform on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

Creating an account, posting content, or checking an acceptance box counts as your electronic signature and acceptance of these Terms.

2. The service

Freedom Wall is a free community platform for publishing, reading, and interacting with user-generated content. We do not charge for core access. We may change, suspend, or discontinue any part of the service at any time, with or without notice.

You can browse much of the platform without an account. To post, comment, react, vote, write articles, or manage a profile, you must sign in, accept these Terms, and follow our community guidelines.

3. Your account

You are responsible for all activity under your account, whether or not you authorized it. Keep your sign-in credentials secure and tell us promptly if you suspect unauthorized access.

Provide accurate information and choose a username that does not impersonate others, infringe rights, or violate these Terms.

We may refuse, suspend, or terminate any account at our discretion, with or without notice.

4. User content

You keep ownership of content you submit, but you are solely responsible for it and for any consequences of posting it.

By submitting content to Freedom Wall, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, display, perform, adapt, modify, publish, translate, create derivative works from, and otherwise use your content to operate, promote, improve, and secure the platform.

You confirm that you own or control the rights to your content, that it is lawful, and that posting it does not violate any law or third-party right.

We do not endorse, verify, or guarantee the accuracy of user content. Views expressed by users are their own and do not represent our views.

5. Prohibited conduct

You agree not to use the platform to:

  • Break any applicable law, regulation, or third-party right.
  • Harass, threaten, defame, abuse, stalk, or harm another person.
  • Post hate speech, illegal content, sexually exploitative material, or content that harms minors.
  • Impersonate any person or organization, or misrepresent your affiliation.
  • Spam, manipulate votes, scrape data, or disrupt the service.
  • Upload malware or attempt unauthorized access to accounts, systems, or data.
  • Use the platform for commercial solicitation without our prior written consent.

6. Moderation and enforcement

We may, but are not required to, monitor, review, remove, restrict, or reject content or accounts at any time, in our sole discretion.

We may apply posting limits, cooldowns, or other technical restrictions to protect the service and community.

If we do not enforce a provision at one time, that does not waive our right to enforce it later.

7. Third-party services

The platform may use third-party providers, including Google and Firebase. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services, websites, or content linked from the platform.

8. Assumption of risk

You use the platform at your own risk. You may encounter content that is offensive, inaccurate, or otherwise objectionable. You accept the risks that come from interacting with other users and from content you access on the platform.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FREEDOM WALL AND ITS OPERATOR, OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS PROVIDE THE SERVICE AND ALL CONTENT "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FREEDOM WALL OR ITS OPERATOR, OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED (100) IN THE CURRENCY OF THE JURISDICTION IN WHICH THE CLAIM IS BROUGHT.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless the operator of the platform and its owners, affiliates, officers, employees, agents, licensors, and service providers from claims, losses, liabilities, damages, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the platform.
  • Your content or conduct.
  • Your violation of these Terms.
  • Your violation of any law or third-party right.
  • Any dispute between you and another user.

12. Release

To the fullest extent permitted by law, you release the operator and its affiliates from claims, demands, and damages of every kind, known or unknown, connected with disputes involving other users or third parties, or with content posted by other users.

13. Disputes and governing law

These Terms are governed by applicable law, without regard to conflict-of-law rules that would apply another jurisdiction's law.

Disputes arising from these Terms or the platform will be resolved in courts or tribunals of competent jurisdiction, except where mandatory consumer protection laws in your country require otherwise.

You waive any right to participate in a class action, class arbitration, or representative proceeding against us, to the fullest extent permitted by applicable law.

14. Termination

You may stop using the platform at any time. We may suspend or terminate your access immediately, with or without notice, for any reason.

Sections that should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, indemnification, release, and governing law.

15. Changes to these Terms

We may update these Terms by posting a revised version on this page and updating the last updated date. For material changes, we may also notify you through the platform where appropriate.

If you keep using the platform after changes take effect, you accept the updated Terms. If you do not agree, you must stop using the platform.

16. General

These Terms, together with the Privacy Policy and any additional rules posted on the platform, are the entire agreement between you and us regarding the service.

If any provision is invalid or unenforceable, the remaining provisions stay in effect.

Our failure to enforce a right or provision is not a waiver of that right or provision.

You may not assign your rights under these Terms without our consent. We may assign ours freely.
